Several documents that were released on November 12, 2004 could very well cast reasonable doubt or end the conspiracy charges against Michael Jackson. The documents include correspondence from Mark Geragos, who represented Michael Jackson at the time, and William Dickerman, the attorney for the mother of Jackson's accuser.
The letters primarily contain requests for the return of the mother's household belongings and her concern for the storage fees and who would be paying for them. The letters are dated soon after the time period in which the mother claims she was fearful for her life and was imprisoned by Jackson's employees, yet they make no mention of these things.
The kidnapping charges are similar to charges that were previously made by the mother against her ex- husband. She accused him of molesting their daughter, kidnapping, and threatening her life. The daughter later recanted her statements.
Russell Halpren, who is the attorney for the father of the accuser, believes that the mother "scripts" her children so they know exactly what to say if they are questioned and claims to have seen a script that the father had shown him in the past. "She wrote out all their testimony", said Halpren. The sexual charges against Michael Jackson are the third sexual charges this mother has made. Aside from Jackson and her own ex-husband, she has also accused J.C.Penny security guards of sexually abusing her by fondling her breasts and crotch in a parking lot after they followed her son and husband out of the store for shoplifting. Her son was found with several unpaid clothing items. She did not mention the alleged sexual abuse by the guards until two years after the incident allegedly occurred. The case was settled out of court for a reported ,000, to avoid negative publicity for the company.
In addition to the letters, there have been questions in other areas of this case. Michael Jackson was charged with seven counts of child molestation in the first indictment, but the charges were declined to three, with one alleged molestation attempt. Also, there were charges added in the second indictment that were not present in the first, such as: conspiracy to commit twenty-eight felony acts, including conspiracy to commit child abduction, false imprisonment, extortion, committing lewd acts upon a child, attempting to commit a lewd act, and administering intoxicating agent (alcohol) to a child. There have also been several changes to the timeline in which the allegations took place.
These discrepancies are key items for the defense and will surely not be overlooked by Jackson's team. On November 8, 2004 in a pre-trial hearing, Jackson attorney Susan Yu stated, "These dates are different because the (accuser's) family changed their story. They changed their story because they are not telling the truth."
